The Rule

The Office of Federal Contract Compliance Programs (OFCCP) has issued a rule regarding "internet applicants." This rule applies to contractors and subcontractors of the U.S. Government. MilitaryHire will provide new features as a part of our website to assist you in complying with the OFCCP rule.

MilitaryHire Compliance Features

The following features will be added to MilitaryHire.com. Note: these features will only be enabled for accounts that request OFCCP compliance.

  • MilitaryHire.com will solicit gender and ethnicity information from job seekers when they register.
  • MilitaryHire will capture the following information for each OFCCP compliant search:
    • A requisition number for the position for which the search was made.
    • The date of the search.
    • The search criteria used.
    • The resumes that were returned as results for the search.
  • MilitaryHire will capture the resume, gender, and ethnicity for all job seekers who apply for an OFCCP compliant job posting.
  • All captured data will be stored for a minimum of two years. This data will be made available to you in the event of an audit.

Does OFCCP Compliance apply to me?

The rule applies to contractors and subcontractors of the U.S. Government. If your company does business with the federal government, your legal and human resources departments should review the rule to determine your obligations.

How do I sign up?

Contact help@militaryhire.com and let us know you want OFCCP compliance enabled for your account. There is a set up fee for three star customers. Set up is complimentary for four and five star customers.

What else do I need to do to be compliant?

Each time you search for resumes on MilitaryHire, you will be prompted to enter an "OFCCP Requisition Number." This number must match the job requisition number in your company's human resources computer system for which the resume search is conducted.

You must also provide an "OFCCP Requisition Number" for each ResumeScout you currently have active. To do so, go to My Resume Scouts and edit each scout to enter the proper requisition number. Remember to keep the scouts up to date with the correct requisition numbers as jobs are filled and new positions opened.

You must retain the records of your job openings for two years. The OFCCP Requisition Number you enter on MilitaryHire must match the requisition number of a job opening in your system. In the event of an audit, you will use the numbers entered when searching MilitaryHire.com to match searches with the job openings the searches were associated with.

Please keep in mind that responsibility for OFCCP compliance rests with your company. MilitaryHire can assist with some aspects of compliance, but we cannot replace a thorough plan developed by your company in consultation with legal experts. There are aspects of compliance that do not involve our systems at all and must be addressed by your human resources and legal departments.

How can I tell whether my account is already OFCCP enabled?

Log in to the Command Post->My Account Activity and look for the "OFCCP COMPLIANCE" indicator as shown in the example below. If your indicator says "on," your account is enabled for OFCCP compliance. The MilitaryHire OFCCP compliance features listed above are enabled for your account. If your indicator says "off," your account is not enabled with the OFCCP compliance features. OFCCP indicator

How do I access the data in the event of an audit?

In the event of an OFCCP Compliance audit by the Department of Labor, contact MilitaryHire at help@militaryhire.com. Your data will be available one to two weeks after the request is submitted. There will be a data retrieval fee of $250. MilitaryHire will require verification of a government audit before providing any data.
