Essential Job Functions:
The Judiciary Clerk processes civil cases, landlord/tenant cases, and special proceeding cases from initial filing through post-judgment action and until the cases are closed. The incumbent also assists the public at the counter and on the phone with questions about District Court procedure or general court information. The Judiciary Clerk must maintain an organized and efficient workflow, helping with all duties to make the office run smoothly. This position is essential personnel and subject to call-in during emergencies and adverse weather conditions.
Essential Duties and Responsibilities:
Process post-judgment filings such as Oral Exams, Garnishments, Writs of Execution, Motions, Liens, and Appeals. Verify judgment information on the filings. Enter the appropriate information into the data system and follow through with necessary action(s). Prepare civil status notices or deficiency notices when needed. Process judge?s rulings on motions. Pull and scan files for incoming work, order files from archive to be scanned.
Answer telephone and counter inquiries. Direct the public to the proper action/ agency. Provide necessary explanation to complete District Court forms or on procedures.
Enter new civil complaints filed over the counter into the computer system and process new cases through File & Serve, prepare transmittals for service of the summons. Enter reissues of summons and set the new trial dates for the cases. When cases are contested, enter information into the system and reset the trial date.
Prepare trial dockets, verify, print and post the docket. Enter postponements, continuances, judgments, dismissals or other actions noted by the Judge into system. Check to make sure docket sheets and costs are correct.
Prepare transmittals and summonses for service. Manually process Failure to Pay Rent Cases. Type rent docket. Check rent cases coming back from court for completeness. Separate money judgments on Failure to Pay Rent cases. Process Warrants of Restitution, send to judge for signature, to sheriff for service, and to parties for notice. Maintain
statistics regarding numbers of evictions.
Enter Petitions for Domestic Violence, Peace Orders, and Emergency Evaluations into the system. Research other cases between parties. If order is granted, forward a copy of the order to the sheriff, fax request for DSS report if ordered, enter actions into the system and prepare files for later hearings. Process the post-hearing filings through termination of case.
OTHER DUTIES: Back up cashier weekly and serve as the primary cashier periodically, accepting payments for civil, criminal, traffic, and appeal filings and fees. Open and distribute mail. Prepare transmittals to the sheriff. Act as counter back up. Process Bond Forfeitures and Municipal Infraction cases. Prepare refund requests. Prepare bond form when defendants are brought in on body attachments. Fill in for Judge?s secretary or other
positions when needed. Conduct bank runs when change is required. Deliver mail to post office or collection box receptacles.
Minimum Qualifications:
Education:
High school diploma (or GED equivalent).
Experience:
One (1) year of work experience, preferably in court operations or in the fields of criminal justice, parole and probation, legal or financial services.
Note:
A Bachelor?s Degree may substitute the required work experience.
A Paralegal/Associates Degree or 60 college credits may substitute the required work experience.
A Paralegal Certificate may substitute the required work experience
Knowledge, Skills, and Abilities:
Knowledge of:
General office practices, procedures and equipment.
Standard legal forms and documents used in the Judiciary.
Basic English and arithmetic to include, but not limited to, spelling, punctuation, addition, subtraction, multiplication, and division.
Skill in:
Customer service and handling problems tactfully and patiently.
Typing on a personal computer.
Accuracy and attention to detail.
Ability to:
Use standard office and business equipment including, but not limited to, personal computers, word processing, spreadsheets, database software, copier, microfilm machine, register, scanner, fax machine, etc.
Use and maintain alphabetical and numerical filing systems.
Communicate clearly, tactfully, and effectively with judges, the public, police agencies, attorneys and other court officials and personnel, both verbally and in writing.
Understand and abide by departmental rules, regulations, and procedures.
Exercise tact, diplomacy, and impartiality in dealing with the public, law enforcement personnel, and attorneys.
Follow procedures, verbal and written instructions, and protocols for any given assignment.
Use proper grammar, punctuation, and spelling.
Exercise independent judgment in interpreting and applying appropriate policy, procedure, rule, law, and/or regulation to a situation.
Resolve complex situations, routine problems and diffuse tense situations as necessary.
Multi-task, set priorities, and work efficiently.
Learn new procedures and laws affecting Civil cases
Physical Requirements:
Exerting up to 20 pounds of force occasionally, and/or up to 10 pounds of force frequently, and/or a negligible amount of force constantly to move objects. If the use of arm and/or leg controls requires exertion of forces greater than that for sedentary work and the worker sits most of the time, the job is rated for light work.
Equipment, Machinery and Tools:
Computer to enter all processing, type correspondence, print envelopes, check email.
Copier to make copies for customer, copies of judge?s order, status notices, etc.
Cash Register to ring up fines/ filings that are filed with the court.
Fax Machine to send requests for DSS orders, send orders to Sheriff Dept.
Printer to print summonses, mailers, labels, etc.
Credit Card Machine to process credit card payments by customers
Software and Computer Skills:
Windows
Odyssey Case Management System to process cases.
File & Serve to accept e-filings.
Microsoft Word to process documents in Odyssey.
Connect to submit timesheets, leave requests and employee evaluations.
Outlook to access email.
J-Portal to access secure case search for related cases between parties in Domestic Violence/Peace Order cases.
Excel to create or update spreadsheets.
Microsoft Teams to communicate with everyone in the department and in the Judiciary.
