Essential Job Functions:  

The Judiciary Clerk initiates new Civil Foreclosure cases in the MDECC computer system for Baltimore County Circuit Court. Maintains case docket by reviewing and entering records of case documents as they are received. Prepares summonses, issues writs of possession, notices, and other related documents. Enters and indexes judgements of possession. Assists the public and attorneys by providing information about the status of Foreclosure cases or Clerk?s Office procedures both at the counter and by telephone.

Essential Duties and Responsibilities:

Check in and process new Foreclosure cases.

Docket pleadings and orders.

Mail true test copies of orders to parties and/or their attorneys.

Check Certificates of Authority for different bond companies and process the bonds.

Research case numbers for Certificates of Publication.

Submit Notices of Sale to newspapers for publication.

Enter judgments of possession.

Issue writs of possession.

Send copies of Indemnity Deed of Trust Foreclosures to our Land Records Division and to the Attorney General?s Office.

Assign Foreclosure cases to a Court Auditor after ratification of the sale has taken place.

Review Foreclosure cases for exceptions prior to submitting the Auditor?s Report to the Court for final ratification.

Process Show Cause Orders for deficiency decree motions.

Prepare summonses.

Enter monetary judgments.

Issue writs of garnishments and execution.

Check in and record Foreclosures from another county or Baltimore City when part of the property is in Baltimore County.

Transfer files to necessary divisions.

Assist attorneys and pro se litigants in filings and understanding court procedures all while being resourceful enough to answer their questions without giving legal advice.

Answer telephone calls and assist the public, accordingly, including directing pro se litigants to other related county and / or state agencies who could further assist them.

Other duties as assigned.

Minimum Qualifications:

Education:

High school diploma (or GED equivalent).

Experience:

One (1) year of work experience, preferably in court operations or in the fields of criminal justice, parole and probation, legal or financial services.

Note:

A Bachelor?s Degree may substitute the required work experience.

A Paralegal/Associates Degree or 60 college credits may substitute the required work experience.

A Paralegal Certificate may substitute the required work experience.

Knowledge, Skills, and Abilities:

Knowledge of:

General office practices, procedures, and equipment.

Standard legal forms and documents used in the Judiciary.

Basic English and arithmetic to include, but not limited to, spelling, punctuation, addition, subtraction, multiplication, and division.

Reading and applying job-related terminology, codes, policies, procedures, rules, regulations, and laws as required to exercise judgement in their interpretation and application.

Defining problems, collecting, and recording data, establishing facts, drawing valid conclusions, applying common sense understanding and making decisions based on knowledge and experience to solve problems in accordance with established policies and procedures.

Skill in:

Customer service and handling problems tactfully and patiently.

Typing on a personal computer.

Accuracy and attention to detail.

Ability to:

Use standard office and business equipment including, but not limited to, personal computers, word processing, spreadsheets, database software, copier, microfilm machine, register, scanner, fax machine, etc.

Use and maintain alphabetical and numerical filing systems.

Communicate clearly, tactfully, and effectively with judges, the public, police agencies, attorneys, and other court officials and personnel, both verbally and in writing.

Understand and abide by departmental rules, regulations, and procedures.

Exercise tact, diplomacy, and impartiality in dealing with the public, law enforcement personnel, and attorneys.

Follow procedures, verbal and written instructions, and protocols for any given assignment.

Use proper grammar, punctuation, and spelling.

Exercise independent judgement in interpreting and applying appropriate policy, procedure, rule, law, and/or regulation to a situation.

Multi-task by organizing, setting priorities, focusing, and concentrating to simultaneously process work and responsibilities error-free within considerable time constraints and in an environment with continuous interruptions; make corrections as needed.

Physical Requirements:

Sedentary work. Exerting up to 10 pounds of force occasionally and/or negligible amount of force frequently or constantly to lift, carry, push, pull or otherwise move objects, including the human body. Sedentary work involves sitting most of the time. Jobs are sedentary if walking and standing are required only occasionally, and all other sedentary criteria are met.
