Gerber Products Company dba Nestle Infant Nutrition is seeking an Associate General Counsel to join its Legal team in Arlington, VA.

Position Summary:
Legal Counsel supporting all legal issues related to the GERBER brand infant and toddler products. Manage Corporate Compliance and all Legal department. Part of the Nestlé Infant Nutrition legal department, and member of the Nestlé Infant Nutrition Legal Leadership team. This position provides legal services and counsel to Nestlé Infant Nutrition management and employees, including department heads and heads of significant operations/areas of the business.

Primary Responsibilities:
Provides proactive and effective legal services, training and counsel- at all levels of the Company- on a wide variety of legal issues/matters.
Ensures that Company strategies, programs, policies, practices and initiatives comply with all laws
Identifies and advises on the management of potential legal risks in all areas supported by the position.
Assists in developing and coordinating required responses to regulatory authorities, protects company legal interests by utilizing legal experience, technical knowledge and understanding of regulations (FDA, etc.).
Supports various U.S. initiatives of the Company and its affiliates, including Corporate Citizenship.
Represents the business interests in its legal and regulatory relationships with various parties such as vendors, business partners and customers.
Responsible to help manage business risks by identifying and delivering legal support services that promote business development through practical solutions.
Responsible for handling a comprehensive legal workload including providing legal advice and general business transaction assistance in the following areas: sourcing/supply, research and development, public relations including media, quality, medical affairs, regulatory, reviewing and approving marketing materials and communications, promotions and sweepstakes, digital and social media, sales force support, and providing general commercial legal support.
Provides advice and assistance with regulatory compliance and risk management associated matters within areas of assigned responsibility
Supports General Counsel by providing other support services as requested

Functional Responsibilities:
Review Advertising and Marketing Materials and provide legal guidance on marketing initiatives including Sweepstakes and Promotions, digital and social media, print and TV. Serve as subject matter expert on Social Media and Consumer Privacy.
Support all new product launches and review all Gerber® and Graduates ® product packaging legal compliance; collaborate with the business to develop unique and substantiated product claims
Manages legal claims and litigation (general, commercial, and product liability) including representing the company before industry self-regulatory agencies (NAD) . Assists in the oversight and management of litigation related to the business. Responsible for managing litigation through use of outside counsel. Provides outside counsel with required guidance, documents and records necessary for the litigation process.
Participate on cross-functional Incidents Management Committee and provide strategic legal guidance related to escalated incidents
Draft or oversee the drafting of supply contracts, service contracts, consulting contracts, marketing and promotional agreements, licenses, vendor agreements, confidentiality agreements and other transactional documents with respect to the business.
Administer Corporate Compliance Program as mandated by Corporate Compliance Committee
Develop and administer on-going formal training to the business on compliance and emerging legal issues
Support WIC strategy and provide strategic legal advice relating to WIC bids
BS/BA Degree or equivalent, Juris Doctorate degree from Accredited Law School is required. Attorney license in good standing and admission to the bar in at least one state is required. Minimum of 7 years? experience in a corporate law department and general business law required. Solid commercial contract drafting and negotiation skills, along with a solid understanding of key business/financial drivers is required. Experience in advertising, promotional practices, social and digital media and marketing issues (including sponsorship, promotions, competitive claims, consumer privacy and NAD challenges) is required. Experience approving product claims based on substantiation (and the ability to evaluate sufficiency of substantiation) is required. Experience in handling litigation is required. Experience representing companies before NAD is preferred. Experience with R&D and IT clients (development agreements and licensing) is preferred. Experience in Corporate Compliance is required. Experience with FDA, USDA, and FTC requirements in relation to a nutrition environment is required. Antitrust expertise is a plus. Healthcare, FDA, or pharmaceutical legal expertise desirable. Experience reviewing healthcare or related promotional/advertising materials is a plus.
